Terms of Use

1. Acceptance of These Terms

BirthX (“BirthX,” “we,” “us,” or “our”), operated by Alexis Diaz Commodore, provides the birthx.org website and related websites (the “Site”), and related content, products, and services, including the BirthX blog, downloadable article summaries, the BirthBot waitlist, and BirthBot (together, the “Services”). Your use of the Site and Services is subject to these Terms of Use (“Terms”), our Privacy Policy, and our Medical Disclaimer, which are part of these Terms.

By using the Site or Services, you agree to these Terms. If you do not agree, please do not use the Site or Services. Your sole remedy if you are dissatisfied with the Site, the Services, or these Terms is to stop using them.

The Site and Services are intended for people 18 and older. Our educational articles are appropriate for readers as young as 13, but you must be at least 18 to join the waitlist, sign up for BirthBot, or make a purchase.

We may update these Terms from time to time. When we do, we will change the “Last updated” date above, and for significant changes we will post a notice on the Site. Your continued use of the Site or Services after changes take effect means you accept the updated Terms.

In these Terms, our “Affiliates” means our owners, officers, directors, employees, contractors, licensors, service providers, and partners involved in creating, producing, or delivering the Site and Services.

2. Our Services

BirthX provides education and resources about pregnancy, childbirth, and the postpartum period for mothers, fathers, and every kind of family. Our Services currently include blog articles, downloadable one-page summaries, and the waitlist for BirthBot, our text-message education chatbot. You are responsible for your own device, internet access, and any related fees.

No guarantee. We work hard to provide accurate, helpful information, but we cannot promise or guarantee any particular result from using the Site or Services.

Interruptions. The Site may occasionally be unavailable because of maintenance, outages, or services outside our control, such as our hosting, email, or text-message providers.

Changes to the Services. We may change, add, suspend, or discontinue any part of the Site or Services at any time, with or without notice, and we are not liable to you or anyone else if we do. New features are also subject to these Terms.

3. Not Medical Advice

Everything on the Site and in our Services, including articles, summaries, emails, and BirthBot messages, is general educational information only. It is not medical, nursing, or legal advice; it is not meant to diagnose, treat, or prevent any condition; and it does not create a provider–patient relationship between you and BirthX or anyone who writes for us.

Always talk with your own doctor, midwife, or other qualified health professional about your situation. Never ignore professional medical advice, or delay seeking it, because of something you read or received from BirthX. If you think you or your baby may be having a medical emergency, call 911 or go to the nearest emergency room right away. Please read our full Medical Disclaimer at birthx.org/disclaimer.

4. BirthBot and Text Messages

BirthBot is an SMS-based childbirth education chatbot powered by artificial intelligence (AI). BirthBot is coming soon. When it launches, the following terms apply to the BirthBot text-message program in addition to the rest of these Terms:

  • Consent. By signing up for BirthBot, you agree to receive recurring automated text messages from BirthX at the mobile number you provide.
  • Frequency. Message frequency varies based on the schedule you choose (for example, daily or weekly), plus replies to messages you send.
  • Costs. BirthBot costs $9.99 per month (see Section 6). Message and data rates from your mobile carrier may also apply.
  • Opting out and help. Reply STOP at any time to stop receiving messages and cancel your subscription. Reply HELP for help, or email hello@birthx.org.
  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.
  • AI limitations. BirthBot’s answers to questions are generated with the help of AI. They may be incomplete, out of date, or wrong for your situation. Use them as a starting point for conversations with your care provider, not as instructions.
  • No emergencies. BirthBot cannot respond to emergencies and does not monitor your messages in real time. Do not use BirthBot to report symptoms you are worried about. Call 911 or your care provider instead.
  • Your number. You confirm that you are the account holder or have permission to use the mobile number you provide, and you will tell us if you change or give up that number.

We may change or end the BirthBot program at any time. How we handle your phone number and messages is described in our Privacy Policy.

5. Waitlist and Emails

If you join the BirthBot waitlist, you agree that we may email you about BirthBot and related BirthX updates. You can unsubscribe at any time using the link in any email. We use a third-party email service to manage the waitlist, as described in our Privacy Policy.

6. BirthBot Subscription and Payments

Price. BirthBot costs $9.99 per month, plus any applicable taxes.

Automatic renewal. Your subscription renews automatically every month, and we charge your payment method at the start of each monthly billing period, until you cancel.

Cancel anytime. Reply STOP to BirthBot or email hello@birthx.org. Cancellation stops all future charges. Replying STOP also stops BirthBot messages right away.

Refunds. Payments are billed in advance and are non-refundable, including for partial months, except where required by law.

Price changes. We will tell you at least 30 days before any price change takes effect, so you can cancel before you are charged the new price.

Payment processing. Payments are handled by a third-party payment processor. BirthX never sees or stores your full card number. If a payment fails, we may pause or end your subscription.

Any other paid products we offer in the future will show their price and terms at the time of purchase.

7. Acceptable Use

You agree to use the Site and Services only for lawful purposes and in line with these Terms. You agree not to send, post, or share anything through the Site or Services, including messages to us or to BirthBot, that:

  1. is unlawful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, invasive of another person’s privacy, or includes graphic sexual or violent content;
  2. victimizes, harasses, degrades, or intimidates anyone on the basis of religion, gender, gender identity, sexual orientation, race, ethnicity, age, or disability;
  3. infringes anyone’s patent, trademark, trade secret, copyright, right of publicity, or other rights;
  4. is spam, unsolicited advertising, chain letters, or any other form of unauthorized solicitation;
  5. contains viruses or other malicious code, or is meant to disrupt, damage, or limit the Site, the Services, or anyone’s devices; or
  6. impersonates any person or organization, including BirthX or our team.

You also agree not to: try to access areas of the Site or our systems you are not authorized to access; test, probe, or break our security measures; overload the Site or the waitlist with automated or excessive requests; scrape or copy the Site’s content with bots or other automated tools, including to train AI models, without our written permission; or submit someone else’s information to the waitlist or BirthBot without their permission.

8. Our Content and Intellectual Property

“Content” means the articles, summaries, text, graphics, logos, icons, photos, designs, software, and other material on the Site or in our Services. Content is owned by BirthX or our licensors and is protected by copyright, trademark, and other laws.

BirthX, BirthBot, the BirthX logo, and related names, logos, and phrases are trademarks of BirthX. Other trademarks belong to their owners. Nothing in these Terms gives you the right to use our trademarks.

What you may do. You may view the Site, download and print our article summaries, and share links to our pages, all for your personal, non-commercial use. You may quote short passages with credit to BirthX and a link to the original page.

What you may not do. Except as allowed above, you may not copy, reproduce, modify, republish, sell, distribute, or create works based on our Content without our prior written permission.

9. Content You Send Us

If you send us material, such as a birth story, feedback, questions, or messages to BirthBot (“Your Content”), you keep ownership of it. You give BirthX a non-exclusive, royalty-free, worldwide license to use, store, and process Your Content to provide and improve our Services. We will only publish your birth story or other personal material with your permission, and we will share it anonymously if you ask.

You confirm that you have the right to share Your Content and that it does not violate these Terms or anyone else’s rights.

Please do not send us confidential information, patentable ideas, or business proposals unless we have agreed in writing. If you send us unsolicited ideas or suggestions, you agree that we may use them without any obligation to you.

10. Copyright Complaints

We respect the intellectual property rights of others and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe material on the Site infringes a copyright you own or represent, please send our Designated Agent a notice that includes:

  1. a description of the copyrighted work you believe has been infringed;
  2. the location of the allegedly infringing material on the Site (for example, the page URL);
  3. your name, mailing address, phone number, and email address;
  4. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  5. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and
  6. your physical or electronic signature.

If material you provided was removed and you believe it was removed by mistake, you may send a counter-notice that includes: identification of the material and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; your name, address, phone number, and email; a statement that you consent to the jurisdiction of the federal court for your address and will accept service of process from the person who sent the original notice; and your signature.

We may remove or disable access to material in response to a notice, and we may end access for repeat infringers.

11. Third-Party Websites and Services

The Site links to websites and resources run by others, such as health organizations and research sources, for your convenience. We are not responsible for their content, accuracy, availability, or privacy practices, and a link does not mean we endorse them. We also rely on third-party services to run the Site and Services, such as hosting, email, and text-message providers; your use of their services may be subject to their own terms.

12. Privacy

Our Privacy Policy explains what information we collect and how we use and protect it. It is part of these Terms. By using the Site or Services, you agree that we may handle your information as described in the Privacy Policy.

13. Disclaimer of Warranties

THE SITE, SERVICES, AND ALL CONTENT (INCLUDING BIRTHBOT MESSAGES) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT (A) THE SITE OR SERVICES WILL MEET YOUR NEEDS; (B) THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY CONTENT OR RESULTS WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE; OR (D) ANY ERRORS WILL BE CORRECTED.

CONTENT MAY INCLUDE TECHNICAL OR TYPOGRAPHICAL ERRORS OR BECOME OUT OF DATE, AND WE ARE NOT OBLIGATED TO UPDATE IT. YOU USE THE SITE AND SERVICES, AND DOWNLOAD ANY MATERIAL, AT YOUR OWN DISCRETION AND RISK.

14. Limitation of Liability and Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BIRTHX OR OUR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR PROFITS, ARISING OUT OF OR RELATING TO THE SITE, THE SERVICES, ANY CONTENT, OR ANY WEBSITE LINKED FROM THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless BirthX and our Affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or Services, Your Content, or your violation of these Terms or anyone else’s rights. We may take over the defense of any such matter at our own expense, and you agree to cooperate with us.

15. Suspension and Termination

We may suspend or end your access to all or part of the Site or Services, including removing you from the waitlist or BirthBot, at any time and for any reason, including if we believe you have violated these Terms. Suspected fraudulent, abusive, or illegal activity may be reported to the appropriate authorities. You may stop using the Services at any time, including by unsubscribing from emails or replying STOP to BirthBot. Sections of these Terms that by their nature should continue, such as those about intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive termination.

16. Governing Law and Disputes

These Terms and any dispute relating to the Site or Services are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You and BirthX agree to the exclusive jurisdiction and venue of the state and federal courts located in Suffolk County, Massachusetts for any such dispute, except that either party may bring an individual claim in small claims court if it qualifies.

Before filing a claim, you agree to contact us at hello@birthx.org and try to resolve the dispute informally for at least 30 days.

17. General Terms

Users outside the United States. The Site is operated from the United States. We make no claim that it is appropriate for use elsewhere. If you use it from another country, you do so on your own initiative and are responsible for following local laws.

Notices. We may send you notices by email to the address you gave us or by posting them on the Site. You may send notices to us at hello@birthx.org or at the mailing address in Section 18.

No resale. You may not sell, resell, or commercially exploit any part of the Site or Services beyond the rights given to you in Section 8.

Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of internet, hosting, email, or text-message providers, natural disasters, labor disputes, or government action.

Severability. If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent allowed and the rest of these Terms will remain in effect.

No waiver. If we do not enforce any part of these Terms, that is not a waiver of our right to enforce it later.

Assignment. You may not transfer your rights under these Terms. We may transfer ours, including to a company formed to operate BirthX, or as part of a merger or sale of assets.

Entire agreement. These Terms, together with our Privacy Policy and Medical Disclaimer, are the entire agreement between you and BirthX about the Site and Services, and replace any earlier versions. If anything on the Site conflicts with these Terms, these Terms control.
